By using this website or placing an order with SparkShot Custom Creations (SCC), you agree to the following terms. If you do not agree, please do not use the website.

General Information

SCC is a UK-based business mostly producing specialist 3D printed railway modelling products.

We aim to ensure all product descriptions, images, and pricing are accurate. However, minor errors may occasionally occur. Prices and product details may be updated or corrected without notice.

Orders

When you place an order, you will receive a confirmation email. This confirms that we have received your order, but does not guarantee acceptance.

Orders may be declined or cancelled if:

payment is not completed
there is a listing error
the product is unavailable or discontinued
there is a suspected fraudulent transaction

If this happens, any payment taken will be refunded.

Product Information

SCC products are mostly specialist hobby items designed for railway modelling.

Unless otherwise stated, items are supplied unpainted and may require preparation such as cleaning, sanding, filling, or assembly before use.

Minor surface marks, support points, and small variations are normal for resin 3D printing and are not considered defects.

Customer Responsibility

Customers are responsible for selecting the correct scale, version, and compatibility before ordering.

If you are unsure about compatibility, you are encouraged to contact SCC before purchase.

Made-to-Order Items

Many SCC products are made to order / 3D Print-on-Demand (POD).

Because of this, returns for incorrect selection or change of mind are limited, as outlined in our Returns Policy.

Digital Products

Digital files (where applicable) are for personal use only unless a commercial licence is explicitly granted.

You may not:

resell or redistribute the files
share the files with third parties
upload the files online
use the files for mass production or resale
3D scan, copy, or reverse engineer the files or any derived geometry to create duplicates or modified versions

This restriction applies to SCC digital products and files only.

Separate terms may apply where SCC is commissioned to produce custom design work or modelling services for third parties. In such cases, usage rights will be agreed in writing before work begins.

Commissioned Design Work

SCC may undertake custom design commissions for 3D printed or CAD-based modelling work.

All commission work is carried out on a non-exclusive basis unless explicitly agreed otherwise in writing before work begins.

Ownership & Usage Rights

Unless a separate agreement is made:

SCC retains ownership and copyright of all CAD files and design work
Customers receive a licence to use the design for the agreed purpose and to purchase physical prints where applicable
SCC reserves the right to reuse, adapt, and sell the design or derivative products

Exclusive Rights (Optional)

Where exclusivity is requested, this must be agreed in advance and will incur additional cost reflecting the restriction of future commercial use by SCC.

Where exclusivity is granted, usage rights will be clearly defined in writing before work begins.

Intellectual Property

All SCC designs, files, and physical models remain the intellectual property of Sparkshot Custom Creations.

Unauthorised copying, scanning, recasting, or reproduction of products or designs is not permitted.

Design Origin

SCC 3D printed products are created through original CAD design work based on historical research, published reference material, and interpretation of real-world railway prototypes, including freelance and fictional variants.

While the original locomotives, prototypes, and fictional subjects are part of public domain or published creative works, the SCC models themselves are original creative works representing our own interpretation, design process, and CAD output.

Ownership

SCC retains full ownership of:

all digital files (including STL and CAD data)
all 3D model geometry and design work
all physical product designs and printed models
all product imagery and artwork, except where customer pictures are published with permission and due credit

Purchase of a physical product or digital file does not transfer any ownership rights.

Restrictions

Without written permission from SCC, you may not:

copy, scan, or reverse engineer SCC products
reproduce or recreate SCC models in digital or physical form for commercial purposes
create derivative digital models based on SCC designs
redistribute SCC digital files in any form
use SCC designs or products for mass production or commercial resale

Clarification on Reference Material

SCC designs are inspired by historical railway prototypes and publicly available reference material. However, this does not grant permission to reproduce SCC’s specific models, CAD work, or derived geometry.

Independent modelling of historical subjects using public reference sources is not restricted by this policy.

Enforcement

SCC reserves the right to take appropriate action where unauthorised copying, reproduction, or commercial use of its designs or products is identified.

Liability

SCC is not responsible for indirect losses, misuse of products, or issues arising from incorrect assembly, modification, or use outside of normal hobby modelling practices.

Our responsibility is limited to the value of the item purchased.

Privacy

Your personal data is handled in line with our Privacy Policy.

Website Use

You agree not to misuse this website, attempt to disrupt its operation, or use it for fraudulent activity.

Changes

These terms may be updated from time to time. Continued use of the website means you accept any updated terms.
